There is not anything within the codes to justify the officer making an arrest in this case in accordance to Texas State Statutes. There is no indication that the woman committed an offense in the officers presence or view. The Officer alleged to have a suspicion that the woman had outstanding warrants of some kind. However, there is no available data to determine if the officer was privy to the nature of the crimes that he allege the female to be wanted on. The Officer clearly was harassing the young lady, without probable cause in this case. He did not obtain a warrant for the young woman’s arrest, instead, he sought to arrest her on his suspicions, which is not supported by Texas clearly stated state laws.

Whether one has been deprived of the equal protection and due process of laws as guaranteed by the US Constitution is reflective in the fact as to whether the officer in this case acted with arbitrary discrimination in this case, by singling this young lady out based on what he believes were his suspicions, as oppose to adhering to applicable Texas State Law which notes the legal requirements for arrests without a warrant.

This is clearly murder in the first degree. Even the Texas Courts have available case law that they can defer to in making an expedient arrest in this case for first degree murder.
