ASHER DEAN LUBOFSKY, RESPONDING TO DR. NATHANIEL BERG, GUAM BOARD OF MEDICAL EXAMINERS, DR. MIYAGI

ASHER DEAN LUBOFSKY, RESPONDING TO DR. NATHANIEL BERG, GUAM BOARD OF MEDICAL EXAMINERS, DR. MIYAGI It was disheartening for us to hear that the Guam Medical Licensing Board or GUAM BOARD OF MEDICAL EXAMINERS and Dr. Nathaniel Berg as Chair made a decision on our complaint public, regarding Shishin Miyagi before letting us know first, or clarifying the complaint issues. Very unprofessional, but at the same time, its expected as the lawsuit hit the news and they apparently need to help circle the wagons and help control the narrative.

We are not surprised that the Board and Dr. Nathaniel Berg would find no findings of violations of the Physicians Practice Act, as the board would then have to justify why they licensed Dr. SHISHIN MIYAGI to begin with. The board under the leadership of Dr Nathaniel Berg, has unequivocally stated that they will license doctors who only meet minimal requirements. They have also licensed doctors who have a history of malpractice.

Guam is known by doctors off island as the place to go to with low malpractice insurance and easy to get licensed for those doctors that cant work in other places. The doctors of Guam have also made it near impossible to sue them if you are poor. They have lowered their malpractice rates to benefit themselves and made it so that you do not have a fair Board to complain to as The Medical Licensing Board members have many serious conflicts of interest to make a decision on these cases.

With SDA, as an example, how much does Dr. BERG, ( Dr. Nathaniel Berg )
the Medical Examiners Board Chair, make in referrals from the SDA clinic? Didnt you give legal testimony for SDA in the past, Dr Berg? Do you think you can make a fair decision and jeopardize your SDA relationship, your income? What about the other board members? Do they not have conflicts of interest as well? Do I need to name them? YOU have a GMH representative on the Board. We have a legal case against GMH who left my son in a room with no doctors for 12 hours until he died. Do you think this isnt a conflict of interest Dr. Nathaniel Berg?

The Board must think a 20 minute documented wellness exam of a dying child, where the doctor had also left the room, who was sick and was there for a full physical is okay. That full physical exam with the doctor usually averages 1 hour not 20 minutes. They must think the medical records that show things that were said incorrectly to have been done that were not done to be okay. And if they were done, how in 20 minutes can it all be done? Open your eyes. They were not done, the records were wrong, but the Board made their decision on what SDA submitted and said, not on the reality of the situation and not what we reported and never asked us for any info. Please explain how in 20 minutes a wellness exam could be done?

The board dismissed all the info that was given to them and didnt clarify anything with us believing the doctor and Clinic. By the way, Medical Board, how did my son end up unable to breathe totally, tripod breathing, the day after he saw Miyagi and Miyagi heard nothing? Oh yeah, no stethoscope. Where was my sons fever, throwing up and raspy voice addressed, as you said there was nothing wrong. Why did I have to raise my voice, plead with your licensed doctor, at Miyagi to exam my sick son? Even the SDA medical director knew that as fact as he told me that Miyagi told him. How did Asher end up dead 2 days after seeing your Board Licensed Doctor?
Do you even give a crap about the people of Guam? Tell us Dr. Nathaniel Berg, do you and the Board put personal interests first? Show us, point by point, how you all made your decision and mitigated your own conflicts of interest.
